MetArt Files Infringement Suit Against

LOS ANGELES — The operators of the tube site were hit with infringement claims waged by the MetArt Network on Friday for allegedly streaming its movies and failing to honor DMCA takedown notices.

The suit is one of numerous infringement suits filed this year by MetArt, a Cyprus-based network of erotic sites that all offer nude and explicit sex through fine-art videography.

The lawsuits have been filed at federal courts in Phoenix, Seattle and Los Angeles. Each of the site owners are accused of various copyright and trademark violations, as well as unfair competition.

MetArt hopes to recoup damages that can run into the millions of dollars in each of the cases. The company also is asking the courts to transfer the sites’ domain names to stop future infringements.

As like other the cases, MetArt alleged that’s operator, as well as 20 unnamed defendants, not only did not honor DMCA notices but also failed to implement a reasonable repeat infringer policy.

“ fails to fulfill the requisite conditions precedent to qualify for the safe harbor provisions of the DMCA,” MetArt said in the suit.

MetArt filed seven causes of action in the complaint, including copyright infringement, contributory and vicarious copyright infringement, as well as inducement of copyright infringement, trademark infringement, contributory trademark infringement, false designation of origin under the Lanham Act.

The suit seeks up to $2 million per instance of trademark infringement if found willful, among other requests for relief.
